Marriage age and documents: checks before fixing the date

The legal minimum ages, which age proofs are actually accepted, and the papers worth collecting before the wedding rather than during the week after it.
Almost every family reading this is well clear of the legal minimums and will treat the first section as obvious. It is here because the rest of the article is the useful part, and because the ages are still worth stating plainly in a community where a rishta is occasionally arranged around a girl finishing school.
The ages
The Prohibition of Child Marriage Act, 2006 sets the minimum age at twenty-one for a male and eighteen for a female, and the Hindu Marriage Act, 1955 carries the same ages as a condition in Section 5.
A marriage below those ages is voidable at the option of the party who was under age, and the Act provides for punishment of an adult who contracts such a marriage and of those who perform, conduct or promote it. Arranging around the rule — an engagement now, a wedding when she turns eighteen — is a different thing from breaking it, but families should be clear which of the two they are doing.
What actually counts as age proof
- A birth certificate issued under the Registration of Births and Deaths Act, 1969. This is the cleanest proof and the one to use where it exists.
- A school leaving or matriculation certificate showing date of birth — widely accepted, and what most families in the older generation actually have.
- A passport, where there is one.
- Note that what a registrar accepts is set by state rules. Ask the registrar’s office rather than assuming the document you have is enough.
The other conditions worth knowing
Section 5 of the Hindu Marriage Act sets the full list of conditions for a valid Hindu marriage, and the two families should be able to answer each without hesitating: neither party has a living spouse at the time; both are capable of giving valid consent; and the parties are not within the prohibited degrees or in a sapinda relationship, unless a custom governing them permits it.
That last one is the condition families most often assume is covered by the gotra check. It is not — there is a separate article on this blog explaining why the two rules catch different relatives.
The folder to build before the wedding
- Age and address proof for both parties, in the names that will appear on the certificate.
- Passport-size photographs of both, and photographs from the ceremony itself.
- The printed invitation card. Registrars commonly ask for it.
- Witnesses lined up — people who actually attended, with their own identity documents, and who will be reachable afterwards.
- For an overseas match: passports, the current visa or residence document, and copies of everything held by both families rather than one.
Names, spelled once
A practical nuisance worth heading off: agree the exact spelling of both names, as they appear on the primary identity document, and use that spelling on everything — the registration, the bank, the visa file. A name spelled two ways across three documents creates weeks of work at exactly the point when a family is trying to file a spouse visa.
One caveat
This is a description of the statutory framework and the ordinary paperwork, not legal advice. Documentation requirements are set by the states and vary, so confirm the list with the registrar’s office for the relevant district before you rely on it.
